1. Introduction
Welcome to Trails Co. Ltd (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website (www.trails.com.tr) and our services, including but not limited to private car hire with a driver, guided tours, and tailored travel arrangements.
By accessing our website or booking our services, you agree to comply with and be bound by these Terms. If you do not agree, you must refrain from using our services.
2. Definitions
– “Client,” “you,” “your” – Any person using our services.
– “Service” – Private vehicle hire, chauffeur services, guided tours, itinerary planning, events or any other offering provided by Trails Co. Ltd.
– “Driver” – An individual authorized by us to provide private transportation services.
– “Booking” – A confirmed reservation made via our website, email, or telephone.
3. Services Provided
We offer private car hire with a professional driver, guided tours, airport transfers, and custom travel itineraries throughout Türkiye.
All services are subject to availability.
We reserve the right to refuse service to any individual at our sole discretion.
4. Booking and Payment
– Bookings must be made in advance via our website, phone, or email.
– Full or partial payment may be required to confirm a booking.
– We accept credit cards, debit cards, and online payment gateways.
– Prices are listed in USD and/or GBP and/or EUR, and alternative currencies (GBP/EUR) may be available upon request at checkout.
– Unless otherwise noted, VAT is listed prices.
– A booking confirmation will be sent by email upon successful payment.
5. Cancellation and Refund Policy
Private Tours:
– 48 hours or more before the service date: Full refund
– 24–48 hours before the service date: 50% refund
– Less than 24 hours: Non-refundable
Refunds are issued to the original payment method within 7–14 business days.
Tailored Journeys:
Tailored Journeys are bespoke experiences involving non-refundable third-party arrangements (e.g., hotels, flights, activities, events, venues).
– More than 14 days before start date: Partial refund possible, subject to third-party policies. Administrative fees apply.
– 7–14 days before start date: Up to 50% cancellation fee may apply.
– Less than 7 days before start date: Non-refundable
Changes after confirmation may incur additional fees and depend on availability.
Refunds follow third-party provider timelines and may exceed standard processing times.
6. Right to Cancel (UK & EU Consumers)
If you are a consumer residing in the UK or EU and book services online, you have the legal right to cancel your booking within 14 days of confirmation, unless the services are scheduled to begin within this period and you have explicitly agreed to early performance, thereby waiving your right to cancel.
By requesting a service to be provided within 14 days, you acknowledge and agree that the right to cancel will be lost once the service has been fully performed.
7. Client Responsibilities
– Provide accurate and complete information when booking.
– Be on time for all scheduled services.
– Delays beyond 15 minutes without notice may result in cancellation or additional charges.
– Comply with local laws and respect both the driver and the vehicle.
8. Driver Conduct and Liability
– All drivers are licensed, vetted, and professionally trained.
– Drivers may refuse service to any client engaging in illegal, unsafe, or disrespectful behavior.
– We are not liable for delays caused by traffic, weather, force majeure events, or road closures.
9. Limitation of Liability
– We are not responsible for indirect, incidental, or consequential losses arising from use of our services.
– We are not liable for lost, stolen, or damaged belongings left in vehicles.
– Our total liability in any circumstance is limited to the amount paid for the service.
10. Privacy and Data Protection
By using our services, you consent to our Privacy Policy (www.trails.com.tr/privacy-policy).
– We collect personal information solely to fulfill bookings and improve service delivery.
– All payment transactions are processed securely by certified third-party gateways.
11. Force Majeure
We are not liable for failure to perform services due to events beyond our control, including but not limited to:
– Natural disasters (earthquakes, floods, storms)
– War, civil unrest, or terrorism
– Government regulations, strikes, or pandemics
– Technical or mechanical failures impacting transport
12. Governing Law and Jurisdiction
For clients residing in the UK or EU, these Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
For all other clients, these Terms are governed by the laws of the Republic of Turkey, and disputes shall be subject to the jurisdiction of the İzmir Courts and Enforcement Offices.
13. Amendments
We may update these Terms at any time.
Changes become effective upon publication at www.trails.com.tr. Continued use of our services signifies acceptance of the revised Terms.
